    A Division Bench of the Rajasthan High Court has directed to stay an order issued by a Single Judge Bench of the Court that had permitted all private schools operating in the state to collect 70% of the annual fees chargeable from the parents.

    A two Judge Bench comprising of Chief Justice Indrajit Mahanty and Justice Mahendra Goyal were hearing a bunch of pleas that challenged the Court’s earlier order.

    While staying the order’s operation, private schools have now been directed to “await directions” of the Court and to refrain from taking any “coercive action” against the students. This direction will continue in force till Friday, 9th October 2020.

    The earlier order allowing schools in the state to collect 70% fees was challenged by a plea filed by Advocate Sunil Samdaria. The petition challenged the previous order, labelling it as baseless and one that has no grounds. The petitioner also claimed that the management of the private schools fixed the fees in violation of the RTE Act, infringing all norms of fee regulations.

    The schools argued that they had infrastructural services to maintain and that they had to pay their non-teaching staff, while also bearing the costs of online classes and salaries of teachers.

    Moreover, the petitioner contended that private schools did not give details to the Court of the amount they had spent in schools during the Covid-19 pandemic. Therefore, the order of the single bench should be quashed.

    The matter before the Division Bench of the Rajasthan HC is expected to be taken up next on October 5, 2020.

    The schools have been closed from mid – March across the Country due to the COVID – 19 pandemic.
