Contempt of Court Case: SC rejects Prashant Bhushan’s plea to defer hearing.

    A Three Judges Bench comprising of Justices B R Gavi, Krishna Murari and headed by Justice Arun Mishra today on Thursday, August 20, 2020 rejected Prashant Bhushan’s submission for hearing on sentence by another bench.

    Advocate Bhushan had appealed before the Supreme court to defer hearing on his punishment till his review petition against conviction for contempt of court is filed and decided, with respect to safeguarding liberty of a citizen under Article 21. The court however assured him, that no punishment will be acted upon till his review against the order in the case is decided.

    Refusing Advocate Bhushan’s plea to defer hearing, Justice Arun Mishra told Advocate Bhushan, “…In the zeal of overdoing, you cross the Lakshman Rekha. Nobody should cross…”. However, Advocate Bhushan continued to stand firm on his statements and said that he shall cheerfully submit to whatever punishment the court would impose on him lawfully.

    Dushyant Dave, lawyer for Prashant Bhushan told the SC, “The appeal is correct under judicial review and the sentence can be deferred..”. The Apex Court on August 14, 2020 took Suo Moto action and held Advocate Prashant Bhushan guilty of contempt of court for posting malicious tweets against the CJI for accusing him of denying the citizens “their fundamental right to justice”.
