Trial by Jury is not a new concept for America or other western countries, but this has been not in general practice in India. Few instances of Trial by Jury is still seen in our country, in the matrimonial trial in Parsis. The procedure of the trial is somewhat similar, with Court taking the cognizance of the matter, the trial begin.

Then firstly, the counsel for both the Parties presents their case in front of the Jury and then Jury takes it time to decide the case and pronounce judgment. The jury consists of 12 members and they don’t necessarily have a legal background. In our country, the most famous case of Trial by Jury is K.M Nanavati vs State of Bombay, which is still criticized for the Jury helding a guilty man, innocent.

Ek Ruka Hua Faisla (A Pending Decision) is a story of one such Jury Trial. It is a remake of an American courtroom drama, 12 Angry Men. In this movie, 12 people having different social, economic, and professional backgrounds acts as a Jury in a case where a slum boy of 19 years of age has been accused of killing his father and since it’s a murder he can be sentenced Capital Punishment as well.


The scene opens in a room and in the background we hear the Judge directing the Jury to use their conscience and reasonableness to decide the fate of the boy and if the Jury holds the man guilty, no appeal shall take place. The Jury is required to sit and discuss every argument presented by the Counsels, every piece of evidence should be examined and all statements given by witnesses should be scrutinized. And they should reach to a decision unanimously.

To prove guilt beyond a reasonable doubt by the prosecution is a requisite in the Criminal Justice System. If there is even an iota of the doubt for the innocence of the victim, the judge cannot pronounce judgment against him. This can be called the beauty of law and also a loophole in the law as evidence can be molded and folded in any way and even a guilt person can be proven innocent. While an innocent man may suffer from this, a crooked and clever man may walk out of the Court.

This movie also asserts the claim of the Realist School of Jurisprudence that there are several contributing factors for the judge to pronounce the judgment other than Law. With 12 men with different backgrounds, different statuses in society, different mindsets, everyone has their prejudices and their pre-decided judgment of the case as well. For instance, one jury member holds the opinion that poor people are garbage, and they should be eliminated from society as soon as possible. Other is a heart-broken old father, whose son abandoned his. Then, there is another, who has got tickets for a movie at 6 pm and is more interested in going there than the decision.

There are more aspects to this movie which makes this movie a must-watch for anyone, who wants to know the nuances of the law.
